Nick Boerke Represents Milwaukee Election Observer in Wisconsin Election Complaint

Chalmers Adams attorney Nicholas J. “Nick” Boerke represents Milwaukee election observer Justin Gavery in a complaint filed with the Wisconsin Elections Commission alleging violations of Wisconsin election law by the Milwaukee Election Commission during the August 11, 2026 primary.

Filed with support from the Center for Election Confidence, this case raises concerns involving election-night reporting procedures, bipartisan oversight, election observation, and public notice requirements.

Among other allegations, Milwaukee election officials transmitted audit log files rather than vote totals multiple times on election night, certain election activities occurred without required bipartisan oversight, and observers were restricted from viewing ballot-handling areas. The filing also alleges that required public meetings and testing of tabulating equipment were not properly noticed.

“The Wisconsin Elections Commission must step in and finally hold the City of Milwaukee accountable,” Boerke said. “The voters of Milwaukee deserve better.” The filing asks the Wisconsin Elections Commission to investigate the allegations and ensure compliance with Wisconsin election law in future elections. This case reflects Chalmers Adams’ experience in election law, political law and complex litigation.
