Jerad Najvar (nay-var) is a trial and appellate litigator focused on the aggressive prosecution of cases challenging government overreach and defending constitutional rights.  Najvar has successfully litigated a broad array of matters in state and federal courts, from trial up through the highest levels of the appellate process.  These cases have included hard-won judgments against the U.S. Food & Drug Administration, Federal Election Commission, and Texas Ethics Commission, as well as victories against numerous local government entities in Texas, including two successful First Amendment lawsuits against the City of Houston.  Most recently, he has prevailed against the FDA in the Fifth and Eleventh Circuits in challenges under the Administrative Procedure Act, and secured a jury verdict in a defamation case in Texas. These cases are among the representative matters referenced below.

Jerad has presented oral argument in four different federal circuit courts of appeals (including eight oral arguments in the Fifth Circuit), the Texas Supreme Court, and Texas intermediate courts of appeals.  Most of these cases have involved constitutional issues rooted in the First Amendment, as well as Fourth Amendment issues and structural constitutional guarantees like the separation of powers.  He has also aggressively prosecuted election contests in Texas, employment retaliation cases, and other matters in state and federal courts.

Jerad’s litigation practice combines an intense focus with creative legal reasoning, crisp writing, and strategic vision.  He was part of the legal team that spearheaded McCutcheon v. Federal Election Commission, and served as co-counsel to plaintiff Shaun McCutcheon before a three-judge panel of the U.S. District Court for the District of Columbia through appeal to the U.S. Supreme Court. In McCutcheon, for the first time, the Supreme Court struck down a federal campaign contribution limit as unconstitutional. Jerad also filed an amicus brief on behalf of several gun-rights groups in New York Rifle & Pistol Association v. Bruen.

Jerad is based in Houston but has appeared in courts from California to Washington, D.C. and Miami.  He operated his own firm from 2010 until joining Chalmers Adams in 2024.

Jerad and his wife recently welcomed their first daughter. They are active members of Regina Caeli Parish, where they regularly assist at the Traditional Latin Mass.
